These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and qformative AI Inc. ("qformative", "we", "us", or "our") governing your access to and use of qformative's governed agentic search platform, APIs, and related services (collectively, the "Service").
By creating an account, accessing our platform, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
qformative provides a governed agentic search engine that enables organizations to deploy AI agents with full auditability, data lineage, and compliance controls. Our Service includes:
To access our Service, you must create an account with accurate information. You are responsible for maintaining credential confidentiality, implementing appropriate security measures, notifying us of unauthorized access, and ensuring organizational compliance with these Terms.
qformative processes your data in accordance with our Data Processing Agreement (DPA) and applicable data protection laws including GDPR, CCPA, and other regional regulations. Customer data ownership and control rights are preserved. Data residency options are available for compliance requirements.
qformative commits to 99.9% uptime availability for production environments, 24/7 monitoring and incident response, and automatic failover and disaster recovery capabilities. Service credits may be available per your enterprise agreement.
All intellectual property rights in the Service remain the exclusive property of qformative. Customer retains all rights to their data and content. qformative may use aggregated, anonymized data for service improvement purposes.
Customers agree not to use the Service to:
Either party may terminate with 30 days written notice. Upon termination, customer data will be available for export for 90 days. Enterprise customers may negotiate extended retention periods.
To the maximum extent permitted by law, qformative's total liability shall not exceed the amount paid by Customer in the twelve months preceding the claim.
These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association.
